1. SELLER INFORMATION
Cuomotech.com is an online store managed and owned by Cuomotech S.r.l. (VAT ID: 09461941214), based in Naples, Italy. You can contact us by phone at +39 3426017554 or via email at info@cuomotech.com. These Terms and Conditions apply exclusively to the relationship between Cuomotech and its customers (private individuals purchasing products on cuomotech.com).
Cuomotech reserves the right to modify these General Terms and Conditions unilaterally and at its discretion, without prior notice. All orders are subject to the Terms and Conditions in effect at the time of the order. Changes resulting from new applicable regulations are effective immediately unless otherwise specified.
2. CUSTOMER ELIGIBILITY
Cuomotech sells products on cuomotech.com to private individuals acting as consumers (as defined by Italian Legislative Decree 206/2005 - Consumer Code). By purchasing, you confirm you are acting for purposes unrelated to any entrepreneurial, commercial, or professional activity.
At the time of ordering, the Customer must provide: full name, complete shipping address, an active phone number, and an email address. Customer data is stored in Cuomotech’s customer registry and used to manage the business relationship. 3. PRODUCTS AND PRICE LIST
Product prices include VAT and all other applicable taxes. The sale of used electronic products is often subject to the "margin scheme" (VAT not separately indicated). If a product's price changes after your order confirmation but before management confirmation, the price at the time of the original order confirmation applies. Shipping costs are indicated separately.
Cuomotech constantly verifies price accuracy; however, errors may occur. In the event of a manifest error, Cuomotech will reject the order and offer the Customer the opportunity to purchase the Product at the correct price.
4. CONCLUSION OF THE CONTRACT
Information on the site does not constitute a binding offer. By submitting an order proposal via cuomotech.com, the Customer makes a binding purchase offer governed by these Terms. The contract is concluded when the Customer receives an "Order Confirmation" via email.
Cuomotech may reject an order due to: (i) Product unavailability; (ii) Payment failure; (iii) Suspicion of fraudulent activity; or (iv) Customer default on previous contracts. In case of partial unavailability, the order may be cancelled or partially accepted.
The risk of loss or damage transfers to the Customer upon physical possession of the Product.
5. PAYMENT METHODS
We accept: Credit Card (Visa, MasterCard, American Express), Postepay, PayPal, Bank Transfer, and Cash on Delivery.
We issue electronic invoices. If you require an invoice, please contact info@cuomotech.com immediately after placing your order, providing all necessary billing details. Once issued, invoices cannot be modified. Courtesy invoices will be sent in PDF format via email.
Payment methods must be selected at checkout and cannot be changed thereafter. For credit card/PayPal payments, charges are processed only after verifying data, receiving authorization, and confirming product availability.
6. SHIPPING AND DELIVERY
Products are intended for the country where the order is placed. If you export products elsewhere, you assume all responsibility for import/export regulations. Shipping costs are borne by the Customer.
Delivery estimates (usually 24-48h) are indicative. Cuomotech is not responsible for logistics delays, but guarantees delivery within 30 days. If delivery exceeds this, the Customer may grant a 10-day extension before terminating the contract.
Inspection: Upon delivery, you must check for: (i) package count matching the waybill; (ii) intact packaging and seals. Any damage must be immediately disputed in writing on the courier’s waybill and reported to info@cuomotech.com within 72 hours.
7. RIGHT OF WITHDRAWAL (B2C CONSUMERS)
Pursuant to Art. 52 of the Consumer Code, you have the right to withdraw from the contract within 14 days of receiving the Product, without providing a reason.
To exercise this right, send the RMA Form or a formal written request to info@cuomotech.com. Products must be returned within 14 days of the withdrawal notice. You are liable for any decrease in the Product's value resulting from handling beyond what is necessary to establish its nature and functionality.
Cuomotech will refund the amount using the original payment method within 14 days of receiving the return, or proof of return shipment.
8. LACK OF CONFORMITY
Sales are subject to the legal warranties under the Italian Consumer Code (Articles 129, 130, 132, 134). For used products, given the prior usage, the right to claim defects expires 14 months after delivery (12-month warranty + 2 months to report the defect). The Customer must report defects within 2 months of discovery.
9. CUOMOTECH CONVENTIONAL WARRANTY (12 MONTHS)
Cuomotech provides an additional 12-month commercial warranty on all phones and devices. This includes:
- Fast repair service (starts within 24 business hours).
- Free diagnosis.
- Device replacement if repair is impossible or uneconomical.
Warranty Exclusions: Normal wear (including battery wear), broken/cracked screens, software defects, liquid damage, unauthorized repairs/opening, or removal of the IMEI/Serial Number.
Return Procedure: Report defects immediately via info@cuomotech.com. You are responsible for backing up your data before shipping the device for repair.
10. ID AND PASSWORDS
You are solely responsible for managing your account credentials (Apple ID, passwords). Cuomotech is not responsible for losses due to account mismanagement or forgotten credentials, nor does it provide the original purchase receipt for data privacy reasons.
11. INTELLECTUAL PROPERTY
All trademarks, logos, images, and content on cuomotech.com are the exclusive property of Cuomotech S.r.l. Use for commercial purposes without written authorization is strictly prohibited.
12. GOVERNING LAW AND JURISDICTION
These Terms are governed by Italian law. Disputes are subject to the mandatory jurisdiction of the Customer’s place of residence or domicile. Customers may also use the European Commission’s ODR platform: http://ec.europa.eu/odr.
